By accessing the Website you are agreeing to be bound by these Terms.

Applied Healthcare Solutions Limited (AHS) reserves the right to amend these Terms at any time and without notice. It remains your responsibility to check the Terms and continue to abide by them in their most current form for so long as you wish to continue using the Service.

The content and design of the Service are subject to copyright owned by AHS. The Service is provided to Bristol Association of Sessional Doctors (BASD) franchise, which is responsible for the operation of the Website and all its associated user-generated content.

Any issues relating to the use of the Website or content of the Website should be directed to the BASD franchise via ali@basd.org.uk.

AHS is not a resourcing agency and accepts no responsibility for issues of any sort arising from bookings undertaken via the Website, nor any liability for damages caused by use of the Service. It is the responsibility of users to negotiate the terms and conditions of any work undertaken with prospective employers.

Due to the information-sharing nature of the Service among users, the Website may include links to third-party websites, internet locations and other forms of content not owned nor controlled by AHS. The linked content is provided to support the intended business of the Website, but AHS accepts no liability for, nor makes any guarantees about, any such content Any external content, however linked to the Website, is not subject to these Terms.

Privacy Policy

For the duration of your use of the Service, AHS ask you to provide us with certain personally identifiable information that we may use to contact you or to identify you should circumstances require. Your personal email address will not be disclosed to other users of the Service. Users of the Service may contact each other via the private messaging system, which obscures your personal contact details for reasons of safeguarding and security. Please do not disclose your email address or any other personal information to other users without due regard.

Personally identifiable information, such as your phone number and links to your social media profile, will only be displayed to other users who view your profile, if you provide these details yourself, however, these fields are not required.

Any material (such as vacancies, events or discussions) you post on the Website will be visible to other users of the Service. You accept that any information, personal or otherwise, supplied via such posts is entirely your responsibility and posted at your own risk.

Prospective employers and Educational Providers may have their contact details disclosed to other users in connection with a specific vacancy or event, and agree to disclose them as part of the Service. Prospective employers and Educational Providers will be able to contact individual users using the Website private messaging system, but all other avenues of communication and personal details are supplied solely at the individual’s discretion. AHS will not under any circumstances circumnavigate an individual’s right to privacy. However, it also recognises no burden to moderate interactions between users that do not form part of the service.

Payment

Some categories of access to the Service attract a subscription fee, which is payable to the BASD franchise. As soon as you have completed the registration form on the Website, you will be granted limited access to the Service. You will be granted full access once you have set up your subscription using the AHS payment gateway.

Your payment information is collected solely for the purpose of processing your subscription where subscriptions are payable, and is not stored by AHS.

Personal financial information is only collected via a third-party payment gateway called Go Cardless. Go Cardless is authorised by the Financial Conduct Authority and operates according to its own privacy policy to ensure your personal information is protected. In the event of non-payment, AHS reserves the right to immediately and indefinitely suspend your access to the Service, with no obligation to remedy you for any loss of earnings, positions or opportunities by so doing. If you use the Service under false pretences and thereby gain a lower rate of payment, AHS also reserves the right to demand any monies as may be owed to it to cover the entire duration of underpayment, plus any fees required for the collection of same.

Cookie Policy

When you use the Website or any part of the Service accessed via a web browser, AHS may place a number of cookies into that web browser. AHS uses first-party session cookies for identification that exist only while you remain logged in to the Website. AHS also uses first-party persistent cookies for analytics in order to optimise the Website and improve the user experience. You can instruct your browser to refuse cookies, but this may prevent access to some parts of the Service.

Security

Access to the Service is over the public Internet which unfortunately is not completely secure. To mitigate the risks and secure personal data stored via the Service, AHS requires user authentication for login to the Website. You must ensure that you keep your login credentials private and for your sole use. You agree to immediately notify AHS of any unauthorised use of your login credentials by email to info@primarycareexchange.com.

Acceptable Use

In using the Service you agree not to:

• Use the messaging system to send junk mail, spam or unsolicited messages that are not consistent with the purpose of the Service.
• Post or publish information that is defamatory, obscene, abusive, discriminatory, threatening or unlawful.
• Use information in a way that infringes copyright, trademark, patent or other property rights of any party.
• Impersonate any person or entity for the purpose of misleading others.

We reserve the right to remove any material on the Service that breaches these Terms or is otherwise deemed objectionable without remedy or recourse.

Termination

We reserve the right to terminate your access to the Service immediately, without notice or liability for any reason, including breach of these Terms.

You can cancel your subscription at any time. There is no cancellation charge. However, no refunds will be provided. If you choose to cancel your subscription or if you default on a payment, then your account will be suspended and you will be notified of this.

Indemnity

You agree to indemnify and hold AHS harmless from any breach of these Terms by your action or inaction. You also agree to indemnify and hold AHS harmless in any claim brought against AHS by any third party arising out of your use of the Service and/or any content submitted, posted or transmitted by you.

Limitations of Liability

Use of the Service is at your own risk. We provide no endorsement of the content of the Service, which is provided without warranty of any kind. The Service may be unavailable for indeterminate periods of time, and you accept our lack of liability for any damage or loss incurred as a result of the Service being unavailable. Furthermore, you agree not to seek damages or compensation of any kind as a result of such.

We also reserve the right to take down the Website from time to time for maintenance purposes. No refund will be given for times when the Website is offline.

Governing Law

These Terms shall be governed and construed in accordance with the laws of England.
